District Court in New York Issues Nationwide Injunction Against Rescission of the DACA Program

The district court issued a nationwide preliminary injunction ordering the government to maintain the DACA program on the same terms and conditions that existed prior to the 9/5/17 DACA rescission memo, subject to the same limitations as the 1/9/18 injunction issued in DHS v. Regents of the University of California. (New York v. Trump, 2/13/18)

New York and 14 other states plus the District of Columbia filed a lawsuit in federal district court challenging the Trump administration’s rescission of the DACA program. The plaintiffs asked the court to enjoin the government from rescinding the DACA program and from using information obtained in DACA applications or renewal requests for immigration enforcement against DACA applicants or their families.
